In the midst of the worrying rise in COVID cases in recent weeks in Argentina, federal judge Alfredo López ordered the suspension of the promotion of the campaign/vaccination plan against COVID in children and adolescents.
The magistrate in charge of Federal Court No. 4 of Mar del Plata established the precautionary measure that affects children between 6 months and 16 years.
“Without implying prejudgment on the merits of the matter, the precautionary measure is decreed until the implementation of the necessary measures is verified by the Ministry of Health of the Nation in order to guarantee access to information related to the effects of the inoculation of those vaccines against covid-19 authorized for distribution in our country,” the text states.
According to López, “there is no complete information on the results of the clinical trials carried out to date, nor with data on the stages actually completed (and how the emergency context has modified the procedures for such purposes).”
The judicial decision seeks to ensure that parents or guardians are notified at the time of inoculation about the contraindications of these products, the possible adverse effects and the right to compensation they have in the event of death or total or partial disability due to vaccination. .
“It is provided that the measure be completed in due coordination with the provincial and municipal health authorities, who are in charge of the operational implementation of the aforementioned vaccination plan, with respect to which the co-defendants will be in charge of the notification obligation, with subsequent accreditation in the proceedings, avoiding delays that could compromise the rights of the actors”, concludes the document signed by the magistrate.
