The Biden administration has formally proposed extending Title IX protections to transgender students, a measure more intended to protect not women but any biological sex that identifies differently. The proposed changes would expand protection against sex discrimination under Title IX of the 1972 Education Amendments to include “sexual orientation” and “gender identity,” according to a Department of Education press release.
The department has proposed changes to Title IX to commemorate the 50th anniversary of the passage of the Civil Rights Act, which prohibits federally funded schools from discriminating on the basis of sex.
The proposed change would require that every gender-segregated space, program, building, bathroom, and locker room be transgender-friendly. This means that individuals “who may feel like women, although they are biologically male” will share the same private space.
These changes could force schools to let biological men into women’s restrooms in order to get federal funding.
