Soldiers sue The Pentagon over COVID-19 vaccination requirements

Staff Sergeant Daniel Robert of the U.S. Army and Staff Sergeant Holly Mulvihill of the U.S. Marine Corps filed a lawsuit against the U.S. Department of Defense.

seeking a determination that they may not be compelled to vaccinate in accordance with applicable military regulations, federal regulations, federal law, and the US Constitution.

Plaintiffs act on behalf of themselves and all other actors who have previously been infected with COVID-19.

In their documents, they stated that the Ministry of Defense “is already vaccinating military personnel, grossly violating its legal obligations and the rights of military personnel in accordance with federal law and the Constitution.”

They also stated that “Army Ordinance 40-562 provides documented survivors of the infection with a presumed medical exemption from vaccination due to natural immunity acquired as a result of their surviving infection.”
